THE legality of the arrest of mayor and DA leader Helen Zille depends on facts which may be in dispute, says the Centre for Constitutional Rights of the FW de Klerk Foundation.
"Arrest constitutes one of the most drastic infringements of an individual's rights and until the basis of the arrest is formulated, police should be hesitant to resort to this," Nikki de Havilland, deputy director of the centre, said.
Zille and 10 others were arrested on Sunday after an anti-drug march by members of the Peoples Anti-Drug and Liquor Action Committee (Padlac) in Mitchells Plain.
